This case involves a prominent manufacturer of flash memory devices in Kentucky which claimed that a proprietary memory controller system it developed had been directly copied by a domestic competitor. The memory controller system was designed with a novel architecture that greatly improved performance, as well as providing an enhanced degree of security in memory systems that used the architecture. The competing firm released a number of flash memory products that shared similar performance characteristics with the plaintiff firm’s products after the latter had been on the market for several months.
